Ginsburg to miss next week's Supreme Court sessions, but recovery 'on track'

The White House reportedly began quiet preparations for a possible replacement for U.S. Supreme Court Justice Ruth Bader Ginsburg after she missed oral arguments this week. She has been reading legal briefs and participating in cases by relaying her votes to the other justices...

Just before Christmas, Justice Ginsburg had a pulmonary lobectomy to remove two cancerous nodules from her lungs.

Ginsburg had surgery December 21 for two malignant nodules in her left lung, the 85-year-old justice's third bout with cancer.

Dr. Raja Flores of Mount Sinai Medical Center reassured MSNBC's Rachel Maddow on Thursday evening that Ginsburg's absence was "completely routine" for such a taxing surgery, and that "she'll be back in full form, I'd say within a month".

But should she not return for the February 19 public sessions, there will likely be renewed concern for the liberal justice's future. "She even wore her collar the day after Donald Trump's presidential election win to showcase her disapproval of the results".

According to four sources, the White House has told conservative organizations like the Judicial Crisis Network and the Federalist Society to get ready for a noisy confirmation battle.

Now, after 25 years on the bench, Ginsburg has brought that streak to an end, missing oral arguments for the first time on Monday. "According to the thoracic surgeon Valerie W. Rusch, MD, FACS, both nodules removed during surgery were found to be malignant on initial pathology evaluation".

While odds for a recovery from the surgery she had are good, they go way up if the subsequent pathology report shows no cancer in the lymph nodes. That said, I'm willing to call it now: she is invincible. Seated from left: Associate Justice Stephen Breyer, Associate Justice Clarence Thomas, Chief Justice of the United States John G. Roberts, Associate Justice Ruth Bader Ginsburg and Associate Justice Samuel Alito Jr.

Despite that, President Trump may already be thinking that a third Supreme Court appointment could be a possibility.

She has had two previous bouts with cancer, in 1999 and 10 years later.

Doctors discovered the cancer after she fractured three ribs during a fall in her office in November.

The two GOP-led branches are cautiously conferring on a list of possible nominees-and urging allied groups to be prepared-if health concerns force the ailing Ruth Bader Ginsburg, 85, to leave the bench, Politico reported.
