US President Donald Trump's Supreme Court nominee has declined to say whether he thinks sitting presidents can be made to comply with a legal subpoena. Patrick Leahy of Vermont.

Senate Democrats looking to win the battle of public opinion over Supreme Court nominee Brett Kavanaugh are essentially accusing Republicans of concealing evidence to ensure his confirmation before the midterm election.

"I can't give you an answer on that hypothetical question", he said.

In another consequential exchange, Kavanaugh would not say if a president was legally obligated to comply with a subpoena.

He referenced the late Justice Antonin Scalia's saying, "if a judge always likes the outcomes of cases he decides, he is probably doing something wrong".

But demonstrations continued inside the US Senate building where Kavanaugh was being quizzed on Wednesday, with occasional outbursts from protesters, such as: "Sham president, sham justice!" and "No Trump puppet!" Richard Durbin, D-Ill., theatrically pulled out a copy of the Constitution and said he could not find the name of William Burck in the section where it says Congress should provide "advice and consent" to nominations.

"A good judge must be an umpire - a neutral and impartial arbiter who favours no litigant or policy", he said in the excerpts released by the White House.

Kavanaugh likened Roe v. Wade to another controversial, landmark Supreme Court decision, the Miranda ruling about the rights of criminal suspects.

Kyl plans to be in Washington in time to vote on Kavanaugh's confirmation.

"Careful", a second White House official responded email that was sent to Kavanaugh.

Feinstein's assertion that more people would die if Kavanaugh would be confirmed because of his pro-gun stance and his refusal to agree with her assault weapons ban is nothing shy of anti-gun rhetoric at its finest.
