Lula, 72, has been sentenced to 12 years in prison for accepting a luxury seaside apartment as a bribe from a construction firm.

Incarcerated Former President of Brazil, Luiz Inacio Lila da Silva has been barred by the higest electoral court in Brazil from contesting the country's Presidential election in October from jail because of he has been convicted for corruption by a criminal court.

The Workers' Party is expected to appeal the decision to the Supreme Court and has until September 17 to replace Lula with another candidate or forfeit the ticket.

Moments later his Workers' Party (PT) vowed to "fight with all means to secure his candidacy". His Workers Party registered him as its presidential candidate for the October 7 vote anyway, saying he is innocent.

The Workers' Party said in a statement: "We will present all the appeals to the courts so that the political rights of Lula, as provided by law and in worldwide treaties ratified by Brazil, are recognized".

A party statement said the court had bowed to the wishes of Brazil's elites to stop Lula returning to office.

Under Brazilian law, da Silva is ineligible to run because his conviction was upheld on an initial appeal. Finally, the PT stressed that Lula's candidacy is the response from the Brazilian people to those who usurped power (through the parliamentary-judicial coup perpetrated in 2016 against Constitutional President Dilma Roussef).

Justice Edson Fachin disagreed, citing a recent call by a United Nations human rights committee calling for da Silva to be allowed to run while he appeals his conviction.

Lula da Silva was initially found guilty of the charges in July 2017.

Despite the uncertainty over his ability to stand, Lula now leads polls with more than double the share of his nearest challenger, the right-winger Jair Bolsonaro.

But unlike Lula, former Sao Paulo mayor Haddad commands little popular support.

A former metalworker and union leader, he rose through the political ranks to serve two terms as president between 2003 and 2011.

The court will also decide whether or not polls leader Lula can appear in television commercials that are due to begin circulating on Friday. But whether Lula can transfer his popularity to a replacement remains to be seen.
