Who exactly was responsible for starting the fight is unclear, but Stokes said he intervened when two gay men received homophobic abuse outside the Mbargo nightclub, in the Clifton area of Bristol.

However, Stokes and team-mate Alex Hales - who was with him when the brawl took place outside the club in Bristol, southwest England, on September 25 a year ago but was not charged - could still face bans.

It was confirmed later on Tuesday that Stokes will rejoin the squad for the third Test, which gets under way at Trent Bridge on Saturday.

All-rounder Ben Stokes has been left out of England's unchanged squad for the third test against India, the England and Wales Cricket Board (ECB) said on Monday.

Stokes' England team-mate Jonny Bairstow, one of several players who were out with Stokes earlier that evening, said it was great news on both a personal and sporting front. A third man, Ryan Hale, was acquitted of the charge last Thursday on the directions of the judge.

Stokes still faces European Central Bank disciplinary proceedings but, after the jury came back with their verdicts having deliberated for just three hours, the Durham all-rounder is hoping to make cricket has main focus.

Stokes, 27, has insisted he was acting in self-defence when he hit Ryan Ali, 28, and Ryan Hale, 27, after they had abused two gay men near a nightclub in Bristol.

At the moment that the verdict was delivered, Stokes' wife Clare broke down in tears, then Neil Fairbrother, his agent, did likewise.

The criminal case led to Stokes missing some of England's biggest matches, including the Ashes tour of Australia and the second Test against India last week.

Stokes had had "at least 10 drinks" in the hours before the incident, which included a bottle of beer, two or three pints of lager, five or six vodka and lemonades and some Jagerbombs.

"I just didn't want any trouble so I was backing away, trying to retreat". Mr Stokes then allegedly knocked Mr Ali to the floor.

Ali recalled walking along the street with Hale, Barry and O'Connor, "having a laugh and some banter and the next thing I remember is having a tall blond man charging towards me".
