Delhi gang rape: Verdict on review pleas on Monday

India's Supreme Court on Monday upheld the death penalty for three men convicted in the gruesome gang rape and murder of a young woman in New Delhi in 2012.

The bench also ruled that the three convicts were heard elaborately during the stage of their appeal against the Delhi High Court's judgement, and no case had been made out by them for review of the apex court's verdict upholding the death penalty.

"A review of a judgement is a serious step and reluctant resort to... it is proper only where a glaring omission or patent mistake or like grave error has crept in earlier by judicial fallibility", said Justices R. Banumathi and Ashok Bhushan.

Former Congress MP and renowned industrialist, Naveen Jindal, said, "Welcome the SC decision dismissing the review petition and upholding death sentence of the rapists".

The mother of Nirbhaya - the 23-year-old medical student whose horrific gangrape and torture and tortured in a moving bus in Delhi had appalled and outraged the nation six years ago - today welcomed the Supreme Court order that confirmed that the five men responsible will hang. She succumbed to injuries on December 29, 2012 at Mount Elizabeth Hospital in Singapore. The minor was tried in juvenile court and remanded to shelter home for three years before he was released in December 2015. "However, I am happy that my daughter has finally got justice", Singh told reporters.

The case also put the treatment of women in the world's largest democracy in the global spotlight and led to heavier sentences for sex crimes. The trio had then filed review pleas against sentence.


But the defendants' lawyer said he would file a curative petition, the last legal challenge.

Singh, lawyer of two convicts, Pawan and Vinay told ANI he is hopeful that his clients would get justice. While one accused, Ram Singh, killed himself in jail on 11 March 2013, the remaining four were awarded death penalty by a Delhi court on 10 September, 2013.

Devi said she believed that nothing less than the death penalty could curb such crimes.

In 2016, there were some 40,000 rapes reported in India, according to the most recent official figures available.

The gang rape of an eight-year-old girl from a Muslim nomadic community in January has sparked more protests.

India is one of the countries that still permits capital punishment, typically hanging those sentenced to death. However, the Centre amended the rape law to introduce the death penalty as the maximum punishment in gang rape cases.
