The Mill Avenue collision, which killed 49-year-old Elaine Herzberg as she walked across the street midblock, was the first fatal crash ever to involve a self-driving auto.

One of those providers, Hulu, later provided a record of usage on one of Vasquez's phones that showed she was watching "The Voice, " a talent competition show on NBC, right before the collision.

"The report states data obtained from the self-driving system shows the system first registered radar and LIDAR observations of the pedestrian about six seconds before impact, when the vehicle was traveling 43 miles per hour", the NTSB's report on the crash reads.

"The vehicle operator stated that she had been monitoring the self-driving system interface".

Reuters reported that The Voice was streamed for 42 minutes before the collision.

In a statement issued to The Verge, an Uber spokesperson said the company prohibits its autonomous vehicle operators from using mobile devices while working.

Tempe police are looking at a vehicular manslaughter charge in the crash, according to a March 19 affidavit filed to get a search warrant for audio, video and data stored in the Uber SUV. The new report says Vasquez told police she'd been driving without her hands on the wheel, or feet on the pedals.

Vasquez was looking away from the road for long stretches in the time before the crash, according to an internal video showing her that was released by police. The report said that she looked down 166 times while the vehicle was in motion, frequently looking in the direction of her right knee.


A camera inside the vehicle pointed at the driver indicated that she didn't look up until half a second before impact.

Convicted armed robber Vasquez was supposed to act as a "safety driver" and take control of the vehicle if anything went wrong.

Police say Vasquez called 911 immediately after the crash and a field-sobriety test conducted at the scene determined Vasquez was not impaired.

The National Transportation Safety Board, in a preliminary report issued last month, said the autonomous driving system on Uber's Volvo XC-90 SUV spotted Herzberg about six seconds before hitting her, but did not stop because the system used to automatically apply brakes in potentially risky situations had been disabled. Before that happened, Governor Doug Ducey, who had lured the company to Arizona with promises of lax regulation, banned Uber's self-driving cars from the road after the crash. Analysis from Netflix and Google (YouTube's parent company) showed that Vasquez was not watching anything on their services prior to the crash.

The Maricopa County Attorney's Office referred the case to the Yavapai County Attorney's Office after citing a possible conflict of interest.

Uber shuttered its autonomous auto testing programme in Arizona after the incident, and says it plans to begin testing elsewhere this summer, although in some cities it will have to first win over increasingly wary regulators.

While Tempe Police initially said Uber was "likely" not at fault in the accident, they didn't rule out the possibility of future charges against the backup driver.
