A president can't obstruct justice? That's not quite right, legal scholars say

  • Lawyers say Trump ‘dictated’ statement on Donald Jr.’s Russia meeting

Rudy Giuliani, who replaced Dowd as Trump's lawyer after the letter was written, demurred when asked on ABC's "This Week" program Sunday whether the president's power to end a criminal investigation into his own conduct is unlimited.

"The president of the United States pardoning himself would just be unthinkable, and it would lead to probably an immediate impeachment", Giuliani added.

"He has no intention of pardoning himself", Giuliani said on ABC Sunday. "In this investigation, the crimes are really silly", he said, arguing that the firing of Comey previous year could not be construed as obstruction of justice because Trump had the right to fire him at any time and for any reason. "I think if the president decided he was going to pardon himself, I think it is nearly self-executing impeachment", Bharara said.

"There is a real practical effect for the republic if Trump is able to win the silence of other defendants with the use of these pardons", Shugerman said.

Manafort, who was Trump's campaign chairman, faces charges of acting as an unregistered foreign agent and money-laundering conspiracy and also two false-statement charges related to information he shared with the Justice Department about his Ukrainian political work. That is because, they say, obstruction of justice "would amount to him obstructing himself" as the nation's chief law enforcement officer.

"A president could not be prosecuted for murder?"

Why would Mr Trump need to pardon himself?

"The bottom line is that there is no valid answer to the question, 'Can Trump pardon himself?' other than, 'He could try,"' Kalt told The Post. It's wrong, " said Christie, a former U.S. attorney.

The President on Thursday pardoned conservative commentator and filmmaker Dinesh D'Souza, who pleaded guilty in 2014 to USA campaign finance law violations.

Calling the investigation a "long nightmare with the American people", Giuliani also issued a challenge directly to Mueller's team, telling investigators to "man up" rather than seek to subpoena President Trump.

In an email, Harvard Law School Professor Laurence Tribe, a frequent critic of Trump, called the letter "flatly wrong legally and indefensible constitutionally".

Mueller's investigation originally focused on allegations of collusion between the Trump campaign and Russian Federation, but over the past 12 months, the scope expanded to include unrelated charges against Trump campaign associates.

That stance mirrors a memo sent to Mueller in January, and reported Friday by the New York Times.

But the president's powers are expansive, and many questions remain about how Trump's office could protect him from the special counsel investigation examining whether his campaign coordinated with Russian Federation to interfere with the 2016 presidential election. "They were trying to make a broad argument".
