Supreme court dismisses pleas seeking independent probe into judge BH Loya's death

After the court's observation that judge Loya died a natural death, it is clear that the political parties, including the Congress and the AAP, were running a "politically motivated" campaign to "tarnish" the image of Amit Shah, he alleged.

Terming PILs "Political Interest Litigations", he said the Public Interest Litigations were fast becoming a lethal weapon against the nation.

It had come down heavily on alleged accusations, bullying of judges in the top court by some activist lawyers in the Loya case and said that the judiciary and judicial officers need to be saved from such averments.

Amit Shah, president of the ruling Bharatiya Janata Party, had been accused of ordering extra judicial killings in 2005 while serving as home minister in the western state of Gujarat. It had even created fault lines among the top judiciary with four senior-most judges going public with their displeasure over how CJI Misra was assigning cases of far-reaching consequences. Shah was discharged within a month of the judge's death.


The judge was trying the Sohrabuddin Shaikh fake encounter case when he passed away on December 1, 2014, when he had gone to Nagpur to attend the wedding of a colleague's daughter. The court also said it thought of initiating contempt proceedings against petitioners but decided not to go ahead with it. The BJP chief minister said it has been the Congress' culture to "mislead" people on every issue and try to take political mileage out of it. The account of the incident provided by the four judges of the Bombay High Court appeared "credible, consistent and truthful" and "there is no reason for this court to doubt the veracity of their statements". The statement published by Justice Loya's son on January 14 where he said that his father had died of natural causes was also reported to the Apex Court.

Congress Spokesperson Randeep Singh Surjewala posted the letter on his twitter account, saying the effort was to stop an enquiry into the case.

Senior BJP leader Ravi Shankar Prasad said, Congress President Rahul Gandhi, who had made malicious allegations against BJP Chief Amit Shah, should tender apology.

Alleging that the "invisible hand" behind these petitions was of Mr Gandhi and the Congress, Mr Patra said that the Congress chief should be "ashamed" for what he described as a conspiracy to target Mr Shah, the judiciary and the country's democracy.
