The designer of a Kansas waterslide that decapitated a 10-year-old boy was taken into custody after he arrived at a Texas airport late Monday, U.S. Marshals said. The raft Caleb was riding went airborne, hitting a pole and netting created to keep riders from being thrown from the ride.
A grand jury has issued indictments against the park, the construction company that built the slide, former park operations director Tyler Austin Miles, and a co-owner of Schlitterbahn Waterparks and Resorts, Jeffrey Wayne Henry. He faces charges of second-degree murder, aggravated battery, and aggravated endangerment of a child.
Last Wednesday, officials said Kansas plans to conduct a full audit of Schlitterbahn's inspection records before it reopens this spring. He is being held in Texas before being arraigned in Kansas. "These experts noted that Verruckt's design violated almost all aspects" of longstanding industry safety standards. "We are confident that their innocence will be proven in court where we know the facts will show this was an accident".
During the ride's 182 days in operation, 13 injuries were reported, including two concussions.
Henry and Schooley are accused of rushing the waterslide into service.
The indictment claims Schooley was responsible for doing "the math" that went into the slide's design and signed an operations manual claiming the ride met all American Society for Testing and Materials standards.
In a statement to CNN last week, the Schlitterbahn Waterpark called Schwab's death "tragic", but maintained that the defendants would be proven innocent when the case goes to trial. Two women in the same raft suffered facial injuries and lacerations.
Prosapio said Schlitterbahn does not expect any changes to the Kansas City park's season, which is set to open May 25 and runs through Labor Day.
The indictment includes allegations that the management group covered up evidence that would incriminate Miles, and attempted to hinder the police investigation of Caleb's death and other accidents that occurred on the waterslide.
Henry was arrested March 26 and has also been charged with second-degree murder.
Mike Taylor, a spokesman for the Unified Government of Wyandotte County and Kansas City, Kansas, says it does not believe it has the legal authority to shut down a business, other than for an epidemic or contagious disease outbreak.
