'Serial' Subject Adnan Syed Deserves A New Trial, Appeals Court Rules

Adnan Syed, a convicted killer who gained worldwide fame from the podcast "Serial", will finally get a new trial after spending roughly 18 years in prison for a murder he says he did not commit.

"Trial counsel's deficient performance prejudiced Syed's defense... because, but for trial counsel's failure to investigate [McClain], there is a reasonably probability that McClain's alibi testimony would have raised a reasonable doubt in the mind of at least one juror about Syed's involvement [in] Hae's murder, and thus 'the result of the proceedings would have been different.'"

Justin Brown, Syed's attorney, said he spoke to Syed by phone both before and after the opinion was released. Graeff said she would have reversed the lower court's ruling granting Syed a new trial.

While Attorney General Brian Frosh can appeal the ruling to the Maryland Court of Appeals, Brown said the most expedient path to a resolution in the case would be in a Baltimore City courtroom. She was found buried in a shallow grave in Baltimore's Leakin Park. Since the podcast's first season, questions have arisen about Syed's innocence, as well as how effectively his lawyer represented him in trial.

"How can you possibly evaluate an alibi witness without speaking to her?" Prosecutors appealed that decision to the appellate court.

In 2016, a Baltimore Circuit Court judge overturned Syed's conviction and ordered a new trial, based on claims that Syed's trial lawyer failed to cross-examine an expert witness about the reliability of cell tower location evidence. The ruling can still be appealed to the Court of Appeals, the state's highest court, which means Syed's conviction could be upheld.

Brown said if the case were to go to trial, "we like our chances - we like them a lot". But the state appealed that ruling.
